Does the FMLA Apply to Me?

The federal Family Medical Leave Act grants employees of mid-sized and larger the right to up to 12 weeks unpaid leave for certain qualified events, including the birth or adoption of a child, a qualified personal illness or condition, or to care for a sick relative. This leave can include a 12-week block, or, in some instances, leave as needed to address doctors' appointments and fluctuating health conditions such as cancer and multiple sclerosis.

To determine whether you have an FMLA employment issue, we ask the important questions, including:

  • Does your employer have 50 employees or more?
  • Did you work 1,250 hours in the past year?
  • Are you encountering resistance from your employer as you seek permission or accommodations to allow for needed intermittent medical leave from work to deal with a chronic condition or serious illness such as multiple sclerosis (requiring frequent physical therapy) or cancer (requiring radiation or chemical therapy)?
  • Has your employer retaliated against you when you asked for either unpaid or paid leave as provided for in the Family and Medical Leave Act, or when you returned from a maternity leave, medical leave, or leave to care for a family member with a serious illness such as cancer?
